Using Surge Apply
Surge Apply is operated by WhaleSharks, LLC (“we,” “us,” or “our”). These Terms & Conditions govern your use of our website and job application service. By using Surge Apply, you agree to these terms. If you do not agree, do not use the service.
You must be at least 18 years old and able to enter into this agreement. Use your own account, protect your sign-in access, and let us know promptly if you suspect unauthorized activity. You are responsible for keeping the information you provide accurate and up to date.
Your applications, with your permission
Surge Apply helps find jobs, prepare application answers and resumes, and submit applications on your behalf. When you select a job for application, you authorize us to use your saved information to prepare and submit that application to the employer and its application platform. If you enable automatic applications for a saved search, this permission also covers jobs selected under that search until you turn the feature off.
This includes reusing relevant saved answers, processing application-related verification messages, and transmitting your resume and application information as needed. Keep your search criteria and answers current, and review upcoming applications. Removing an unstarted application or pausing automatic applications can prevent future activity, but cannot recall an application already submitted or guarantee that an application already in progress will stop.
You remain responsible for your qualifications, statements, and decisions about where to apply. Do not provide false information or authorize applications for another person without their permission.
AI assistance and your review
AI uses your resume, saved answers, and job requirements to prepare answers and assist with resume editing. It can make mistakes, misunderstand context, or miss important details. Review prepared information where available and correct anything inaccurate before it is used in future applications.
AI assistance is not a verification of your experience or a guarantee that an employer will accept an answer or resume. Keep your original resume and important records. A change to a saved answer does not change information already sent to an employer.
Pro subscription and free trial
Pro costs $20 USD per month and includes up to 10 application submissions per day, AI-assisted resume editing, and automatic applications for a specific saved search. These are service limits, not a promise that enough suitable, open jobs will be available or that every application will succeed.
The Pro subscription includes a 7-day free trial. Unless you cancel before the trial ends, your first $20 monthly payment is charged at the end of the trial. The subscription then renews automatically each month until canceled. Any applicable taxes and the billing terms are disclosed before you confirm your subscription.
Creating an account or signing in alone does not enroll you in a paid subscription. A purchase requires a separate confirmation of the applicable offer and billing terms.
Application Packs
An Application Pack costs $10 USD for 100 application submissions. It is a one-time purchase, not an automatically renewing subscription. Any applicable taxes are shown before purchase.
A submission means an application sent to an employer, not a job suggestion, interview, or job offer. Adding a job to your upcoming list is not itself a submission. Applications remain subject to listing availability, supported application flows, and any required information you need to provide.
Application Packs do not include the Pro free trial or the first-payment refund guarantee described below.
Cancellation and refunds
You can cancel Pro by emailing support@whalesharks.io from the email associated with your account. Send your request before the trial ends to avoid the first charge, or before your next renewal to stop the next charge. We use the time we receive your request, not the time we finish processing it.
Pausing Daily Apply or signing out is not subscription cancellation. Cancellation stops future renewal charges; it does not automatically request a refund of an earlier payment. Canceling a paid subscription leaves access available through the paid period unless that payment is refunded.
Your first Pro subscription payment is covered by a 7-day no-questions-asked refund period starting on the first payment date, not the trial start date. Request a full refund within that period by emailing support. No explanation is required, and using the service does not remove this guarantee. The guarantee does not cover renewal payments or Application Packs.

Your information and privacy
You keep ownership of the resumes and other content you provide. You grant us permission to store, process, adapt, and share that content only as reasonably needed to operate the service for you, including AI-assisted preparation and applications you authorize. You must have the right to provide the content you upload.
Our Privacy Policy explains the information we process, the service providers involved, and your choices. Employers and application platforms handle information they receive under their own policies. Deleting information from Surge Apply does not delete an employer’s copy.
Use the service responsibly
Do not impersonate anyone, submit fraudulent qualifications, upload unlawful or harmful content, interfere with other users, bypass security or service limits, or use Surge Apply to spam employers. Do not probe accounts or systems you are not authorized to access. Respect the rights of employers, application platforms, and other people.
The Surge Apply brand, website design, and software belong to WhaleSharks, LLC or their respective owners. These terms allow you to use the service; they do not transfer ownership of our intellectual property or any employer’s trademarks.
Availability and application outcomes
Surge Apply is an independent application-assistance service, not an employer, recruiter, or hiring decision-maker. We are not endorsed by or affiliated with an employer or application platform merely because its listings appear here.
Listings can close or change, application platforms can become unavailable, and submissions can require additional information or fail. We do not guarantee uninterrupted service, a particular submission time, interviews, offers, or employment. Location estimates and AI-generated material may be inaccurate. We will use reasonable care in providing the service, but cannot control third-party systems or hiring decisions.
Nothing in these terms excludes liability or warranties that cannot lawfully be excluded, or takes away mandatory consumer protections.
Accounts, service changes, and these terms
You can stop using Surge Apply and request account deletion through support. If you have a subscription, include a cancellation request so we can also stop future billing. We may restrict or suspend access when reasonably necessary to address misuse, security risks, or legal requirements. Such action does not remove any refund rights required by law.
We may update the service and these terms. We will post the updated terms with a new date and give notice of material changes as appropriate. Changes to paid pricing or renewal terms will be communicated before they take effect and will not retroactively alter a completed purchase.
